Terms of Service

Agreeing to these terms

You agree to these terms when you create an account or buy credits. If you are using the service on behalf of a company or brokerage, you confirm that you have authority to bind it. We may update these terms from time to time. The date at the top tells you when they last changed, and continuing to use the service after a change means you accept the updated terms. If a change materially reduces your rights, we will email the address on your account before it takes effect.

What is InstantStaged?

InstantStaged is a virtual staging service offered for business and commercial use only. You upload listing photos, and our AI model generates staged versions of those images. By using the service you represent that you are purchasing for business purposes, such as marketing a property for sale or rent, and not for personal, family, or household purposes.

Your account

You sign in with a magic link sent to your email address, so anyone with access to that inbox can access your account. Keep it secure. You are responsible for activity under your account. One account per person or business; we may merge or close duplicate accounts.

Prepaid service credits

You purchase prepaid service credits to use the service. These credits are:

• Non-transferable and tied to your account only
• Of no cash value and not redeemable for cash
• Not a gift card, gift certificate, or stored-value product, and not a deposit; they earn no interest
• Available for 12 months from the date you purchase each pack

Each pack is good for 12 months from the day you bought it. If you buy any new pack, credits that expired within the previous 12 months are restored to your account and take the new pack's expiry date. Unused credits that have not expired keep their own dates; a new purchase does not change them. We will email you before credits expire.

How credits work

One credit buys one photo. After you purchase a photo:

• Every later version of that photo downloads free while your account remains open
• You can run the staging tool up to 20 times on each photo
• Free preview versions are watermarked and not licensed for use in property listings or any other publication

Your photos and the images we generate

You keep ownership of the photos you upload. You give us a license to store, copy, process, and create staged versions of them for the purpose of providing the service to you, including sending them to the AI model that generates the staging. You confirm that you own the photos or have permission from the photographer and property owner to upload and modify them, and that they do not show identifiable people who have not consented.

When you purchase a photo, you receive a perpetual, worldwide license to use the purchased staged versions for any lawful purpose, including property listings and marketing, for as long as you comply with these terms. Watermarked previews stay our property and may not be used outside the service. If you share a listing through the unlisted gallery link, anyone with that link can view those images until you stop sharing.

Acceptable use

You agree not to:

• Upload images you do not have the right to use, or images of people without their consent
• Remove or obscure watermarks, or use previews in listings
• Resell, transfer, or share credits or account access
• Use the service to create misleading images of a property's structure, size, condition, or location, or for any unlawful purpose
• Reverse engineer, scrape, or overload the service, or access it through unofficial means

AI-generated images and your responsibility for how they are used

InstantStaged outputs are produced by a machine learning model. They are illustrations of how a space could look with furnishings and decor. They may contain errors or artifacts and do not represent the actual condition, size, fixtures, or contents of the property. You are responsible for reviewing every image before you use it, for how you label, describe, and use these images, and for any disclosure that virtual staging was applied. If you list a property, rules vary by MLS, check yours. InstantStaged does not guarantee that generated images comply with any MLS rules or regulations.

Refunds and chargebacks

If you have not used any credits from a pack, you may request a full refund of that pack within 14 days of purchase by emailing support@instantstaged.com from your account address. Once any credit from a pack has been used to download a photo, that pack is not refundable. Restored credits and promotional credits are never refundable. Refunds are returned to the original payment method.

If you dispute a charge with your card issuer for credits you have already used, we may suspend your account and revoke access to the downloads from that purchase while the dispute is open. Our records of what you downloaded and when are our evidence of delivery.

Data retention

We keep your data as follows:

• Your original photos and purchased staging outputs are kept while your account is open
• Version trails for each photo are kept for 30 days after the photo's last run
• Unpurchased preview content is deleted after 60 days
• Accounts inactive for 24 months may be closed after we send you email notice
• Purchase and credit records are kept for seven years for financial record-keeping, with your identity removed once your account is closed

Ending the service

You can delete your account at any time from your account page. We may suspend or close an account that breaks these terms, charges back used credits, or has been inactive for 24 months after email notice. If we close your account for breaking these terms, unused credits are forfeited. If we discontinue the service entirely, we will give at least 30 days of email notice and refund unused, unexpired credits.

No warranties

THE SERVICE AND ALL GENERATED IMAGES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY IMAGE WILL BE SUITABLE FOR YOUR PURPOSE, OR THAT USING AN IMAGE WILL PRODUCE ANY PARTICULAR RESULT, INCLUDING THE SALE OR RENTAL OF A PROPERTY.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POWERED BY PILAND LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST COMMISSIONS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

You agree to defend and hold us harmless from claims by third parties arising from images you upload, images you publish, or your use of the service in violation of these terms.

Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by contacting support will be brought in the state or federal courts located in Wake County, North Carolina, and you consent to their jurisdiction. Before filing, you agree to email support@instantstaged.com and give us 30 days to resolve the issue.

General

These terms and our Privacy Policy are the entire agreement between you and us about the service. If any part of these terms is found unenforceable, the rest still applies. You may not assign your account or these terms; we may assign them to a successor that takes over the service. Our not enforcing a term is not a waiver of it.
